2. Website Content

2.1. The materials published on the website are intended for your personal non-commercial use. All materials published on the website, including but not limited to news, photographs, images, illustrations, audio, and video clips (“materials” or “content”), are protected by copyright and are owned or controlled by the Company or the content provider. You must adhere to all additional copyright notices, information, or restrictions contained on any page.

2.2. The content of the website is protected by copyright in accordance with the laws of Ukraine and international copyright law. You do not have the right to modify, publish, transmit, participate in the transfer or sale, reproduce (except as provided in clause 2.4 of these Terms), create derivative works, distribute, perform, or use the website content (including software) in whole or in part.

2.3. Commercial (corporate) names, trademarks, etc., of the Company or third parties are protected by intellectual property rights. Nothing in these Terms shall be construed as granting any license or right to use the Company’s or third parties’ trademarks, patents, design rights, or copyrights, either implicitly or by default.

2.4. You may download or copy the content of the website and other components and elements displayed on the website for personal use only, provided you comply with all copyright and other notices contained therein. Copying or storing any content for purposes other than personal use is strictly prohibited without the Company’s prior written consent.

2.5. Internet portals and mobile applications are allowed to use information posted on the website for free, provided they include an open hyperlink and reference to the original source and within an amount not exceeding one and a half thousand characters of the original text. The use of a larger volume of text is only possible with the Company’s written permission. The use of information includes any reproduction, republication, distribution, processing, translation, inclusion of its parts into other works, and other actions provided for by the Law of Ukraine “On Copyright and Related Rights.” The Company provides written permission for third parties to use its materials at its discretion based on an application sent electronically to infowb@westbrama.com with a mandatory indication of the return postal address. The Company reserves the right to request any additional information from third parties necessary to make a decision on issuing written permission during the consideration of the application. The use of the Company’s materials is only possible after obtaining the appropriate written permission from the third party.

3. Statements and Warranties

3.1. You represent, warrant, and promise that any data of any kind provided through your account will not violate the rights of third parties, including copyright, trademarks, privacy, or other personal or property rights, or contain illegal material, and (b) you are at least eighteen years old.

3.2. By this, you agree to indemnify, defend, and hold the Company and all its officers, directors, owners, agents, information providers, affiliates, licensors, and licensees harmless from any liability and expenses, including legal expenses, incurred in connection with any claim resulting from a violation of these Terms, warranties, or agreements by you or any user of your account. You must reasonably cooperate in the defense of any such claim. The Company reserves the right, at its own expense, to assume the exclusive defense and control of any matter for which you are required to compensate.

3.3. The Company does not guarantee or endorse the accuracy or reliability of any advice, opinions, statements, or other information uploaded or distributed through the accounts of any users, information providers, or any other physical or legal persons. You acknowledge and understand that relying on such opinions, advice, statements, memoranda, or other information is at your own risk. The materials on the website are distributed “as is,” without any warranties, including warranties of title or fitness for a particular purpose. By this, you acknowledge that you use the website at your own risk.

4. Registration and Security

4.1. As part of the registration or account creation process, you will create login credentials by choosing a password and providing an email address. You must also provide certain information about yourself, which must be accurate and up-to-date.

4.2. Each registration is valid for one user. You may not share your login credentials with anyone else to prevent unauthorized access to your account. We may cancel or suspend your access to the website if you share your login credentials. You are responsible for maintaining the confidentiality of the password, which you should not disclose to any representative or agent of the Company. You may not (a) select or use someone else’s account information with the purpose of impersonating that person, (b) use an account without the owner’s permission, or (c) use account information that is offensive, at your discretion. Violating the above provisions is considered a violation of the Terms and may result in the immediate termination of your account.

4.3. We welcome the participation of individuals of any age on the website; however, in order to protect children, individuals under the age of majority cannot register on the website.

4.4. You must notify us of any known or anticipated unauthorized use of your account or any known or anticipated security breach, including loss, theft, or unauthorized disclosure of your password.

4.5. You are responsible for any use or activity on your account on the website, including the use of your account by third parties with your permission. Any fraudulent, offensive, or other unlawful activity may be grounds for terminating your account at our discretion, and we may provide information to the relevant law enforcement authorities.

5. Communication Between the Website and Users

5.1. If you fill out a registration form to obtain certain information, we, as owners and successors, with the permission of certain third-party providers, provide you with information about the materials published on the website.

5.2. You provide, and the Company reserves the right to send you information about changes or additions to goods and services on the website via your email.

5.3. The Company reserves the right to disclose information about usage and demographics provided that it does not disclose your identity. Advertisers on the website may collect and distribute personal information about you only if you consent according to the Company’s Privacy and Personal Data Protection Policy.

5.4. The Company may contact you by email regarding your participation in user surveys, asking questions to improve current or future materials. 6. Termination of Access to the Website

6.2. The Company may, at its own discretion, remove or suspend access to the entire website or its parts for any reason, including violations or non-compliance with these Terms.

7. Miscellaneous

7.1. These Terms are governed by the legislation of Ukraine. Any disputes regarding the implementation of these Terms will be resolved by the appropriate court in accordance with the current legislation of Ukraine.

7.2. Notwithstanding any provisions stated above, nothing in these Terms shall be used to interpret the provisions specified in the Privacy Policy.

Since we are not responsible for the availability of these external resources or their content, you should direct any concerns about any external link to the administrator of such a website.
